What laws concern commercial litigation?
Many commercial litigation cases are asserted as common law claims; these are claims that are not covered by written law and allow for parties to sue for damages that are the result of the carelessness or negligence of another, and it can be proven that such negligence was the direct cause of an injury or some other loss.
There are many statutory claims that govern commercial litigation; statutory claims are based on laws that are enacted by a state legislature or by the US Congress and are written and enforceable. These include a state’s consumer protection statutes, uniform commercial codes, or uniform trade secret acts. There are also federal codes around certain commercial issues, such as the Defend Trade Secrets Act of 2016 or 18 US Code Chapter 57, which governs statutory laws around labor and unions.
